Each year a distributor meets the same income tax questions on purchase TDS, closing stock, scheme income and MSME creditors. When they are left until assessment, the result is usually an addition to

income with interest, raised on records that are by then several years old.

From our Nashik office we prepare returns and handle assessments for trading companies, firms and proprietorships. The current tax year falls under the Income-tax Act, 2025, while earlier years remain under the Income-tax Act, 1961.

Income tax issues in distribution

Stock in a trading business turns over quickly, and the tax questions that follow are seldom about unusual planning. They concern purchase TDS, year-end stock, scheme income and balances owed to micro and small suppliers. A short deduction carries interest from the month it was due, and an unpaid MSME creditor at 31 March is added back to income for that year. The firm reviews each of these before the return is filed. The notes below are general and reflect the law as at 1 October 2026.

  • Tax deducted on purchases

A buyer whose turnover exceeded ₹10 crore in the previous year deducts tax at 0.1% on purchases from a seller that exceed ₹50 lakh in the year (section 393(1), Table Sl. No. 8(ii), Income-tax Act, 2025; section 194Q of the 1961 Act). Large distributors both deduct this tax and suffer it, so each side has to be reconciled with Form 26AS and the annual information statement.

  • Stock, expiry and the return

Closing stock valuation and write-offs of expired or damaged goods flow into the tax computation. Assessing officers frequently ask why stock in the books differs from the stock statements filed with the bank, and the two are reconciled before filing.

  • Schemes and incentives from suppliers

Credit notes, target incentives and display payments are classified consistently as income, as a reduction of purchases or as another receipt. Where a credit note was issued, its timing should follow the agreement and the GST treatment.

  • Payments to micro and small suppliers

A deduction for amounts owed to micro and small enterprises is allowed only if they are paid within the MSMED Act timelines. Section 37(2)(g) of the Income-tax Act, 2025 (section 43B(h) of the 1961 Act) adds unpaid year-end balances to income until the year of payment. The Udyam status of each vendor should therefore be established before 31 March.

  • Proprietors, partners and the business return

Many distributors are partnership firms or proprietorships. Remuneration and interest paid to partners, and drawings against the business, deserve the same attention as the trading account. Where ownership is concentrated, personal and business positions are reviewed together.

Common questions

Which Act applies to our current year's return?

Income from 1 April 2026 falls under the Income-tax Act, 2025. Income of the year that ended on 31 March 2026 is returned under the Income-tax Act, 1961, and notices for earlier years also remain under the 1961 Act.

We buy from hundreds of sellers. How do we manage section 194Q-style deduction?

The purchase system tracks the turnover of each seller through the year, and deduction starts once the threshold is crossed. Challans are reconciled with the purchase ledger every quarter; a check deferred to year end usually leaves gaps.

Does Udyam registration as a trader protect us under the MSME payment rule as a supplier?

Registration on Udyam solely for priority-sector lending does not by itself bring a trader within the payment-protection rule as a supplier. As a buyer from micro and small manufacturers, you may still have to pay within the MSMED timelines or lose the deduction until payment.

Can you handle faceless assessment replies for a trading firm?

Yes, for clients served from the Nashik office. Replies are drafted from the books, stock records and TDS statements of the year under enquiry.
