Taxation for manufacturers

Much of a manufacturer's tax result is fixed during the year, by the date a machine is put to use or a supplier is paid. We handle returns, TDS, advance tax, depreciation, MSME payment rules and assessments for manufacturing companies, firms and the promoters who own them.

A manufacturer deals with depreciation, job-work TDS, MSME creditors, scrap and stock in the same year as the tax return. Any of these, left until the return is drafted, can lead to questions at assessment. From our Nashik office we prepare returns and handle assessments for manufacturing companies, firms and LLPs, and for their promoters. The current tax year falls under the Income-tax Act, 2025, and earlier years under the Income-tax Act, 1961.

Income tax issues in a factory

The income tax position of a manufacturer is largely settled by decisions taken during the year. A missed TDS deduction or an unpaid MSME creditor is usually found only at the tax audit, when the disallowance has already arisen. We examine the points below first. They are general notes, the law is stated as at 1 October 2026, and they do not constitute advice on a particular set of facts.

  • Capital goods and depreciation

Machinery, moulds, dies and tooling are often bought in stages and put to use on different dates. Depreciation is decided by that date. When a machine is to be sold or scrapped, the effect on the block of assets is worked out before the sale.

  • Payments to micro and small suppliers

A deduction for amounts owed to micro and small enterprises is allowed only if they are paid within the time set by the MSMED Act. Section 37(2)(g) of the Income-tax Act, 2025 (section 43B(h) of the 1961 Act) turns unpaid year-end creditors into added income. For this reason, vendors are classified by Udyam registration before the books close.

  • TDS on job work, contractors and freight

Job-work charges, labour contractors, transporters and repair contracts each attract TDS at different rates and thresholds. Expense ledgers are compared with the TDS returns each quarter, and gaps are closed before the tax audit.

  • Scrap, stock and bank statements

Scrap sales and stock valuation reach the tax computation. Officers often ask why book stock differs from the stock statements filed with the bank, and an unexplained gap can lead to a proposed addition. The two are reconciled before the return is filed.

  • Group and promoter transactions

Rent, interest, salaries and sales between the manufacturing company and related entities need consistent treatment on both sides. Large or cross-border flows may also need transfer pricing documentation.

Common questions

Does the Income-tax Act, 2025 change depreciation for plant?

The substance of depreciation continues, although section numbers and forms changed from 1 April 2026. Asset registers and computation workings should use the new references for the current tax year. Earlier years remain under the 1961 Act.

What if we have hundreds of MSME vendors?

Classify them once in the vendor master by Udyam status. Creditors are then aged at each month end and again before 31 March. The tax disallowance follows unpaid balances that breach the MSMED timelines, and the length of the vendor list alone does not decide it.

Can personal and company returns be reviewed together?

Yes. For an owner-managed manufacturer this is usually necessary, because drawings, rent and guarantees link the two.
